Police: Teacher uploaded child porn to his Google account

AUSTIN (KXAN) — Videos of what appears to be child pornography uploaded to a Google account led police to arrest an Austin Independent School District teacher last week.

Police say Joe Martinez, 31, who is a music teacher at Rodriguez Elementary School was arrested and charged with possession of child pornography, Friday. In an arrest affidavit, Austin police started investigating in February when two CyberTips came in from Google stating six videos of apparent child pornography were uploaded to an account in its system. Several weeks later, Google reported to the National Center for Missing and Exploited Children of another video depicting child pornography was uploaded to the same account.

By using the Google user’s IP address, police were able to track the account back to Martinez. A search warrant was issued for Martinez’ apartment on March 31. When police searching his apartment on April 1, they found an external hard drive which contained “images that fit the Texas definition of child pornography,” according to the affidavit.

When questioned, Martinez told police he obtained the child pornography from Tumblr. He then described how he transferred the contents to his Google account and then to his external hard drive, continued in the court documents.

An AISD spokesperson says Martinez was placed on administrative leave without pay last week and is being recommended for termination. The earliest the AISD Board of Trustees can vote to terminate his contract is April 25.

“We take these matters very seriously and are committed to the well-being of our students,” Superintendent Paul Cruz said. “Austin ISD is thoroughly investigating this matter and will assist APD in any way it can.”

While out on bond, Martinez is not allowed to have contact with children under the age of 14 and he cannot have access to the internet.
